Welcome to AssistApp!
These Terms of Service ("Terms") govern your use of the AssistApp website at https://assistapp.top ("Website"), our desktop application ("Application"), and all related services (collectively, the "Services"). By using our Services, you agree to these Terms.
1. Description of AssistApp
AssistApp is a desktop assistant application designed to help older adults confidently use their computers. The Application provides:
- Step-by-step visual guidance with on-screen indicators
- Voice-activated and text-based help requests
- Real-time scam protection and security warnings
- Accessibility features including zoom, text-to-speech, and adjustable text sizes
- Task history for quick repeat of common tasks
- Optional Caregiver Dashboard for family members to provide remote support
2. Account Registration and Eligibility
To use AssistApp, you must:
- Create an account using a valid email address or Google OAuth
- Be at least 18 years of age (or have parental/guardian consent)
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
3. Subscription Plans and Pricing
3.1 Free Plan
- 10 tasks per month
- Access to all basic features including voice assistance, visual guidance, and scam protection
- Limited Caregiver Dashboard access
3.2 Pro Plan ($10/month)
- Unlimited tasks
- Full Caregiver Dashboard access with email notifications
- Priority customer support
- Enhanced scam protection monitoring
- Complete task history with quick repeat functionality
3.3 Billing
- Subscriptions are billed monthly in advance via Stripe
- You authorize us to charge your payment method for recurring subscription fees
- Prices are subject to change with 30 days notice
- You can upgrade, downgrade, or cancel at any time through your account settings
4. Refund Policy
We offer a full refund within 7 days of your initial subscription purchase if you are not satisfied with the service. To request a refund, please contact us at bartzalewskidev@gmail.com. Refunds are not available for subscription renewals.
5. License to Use Application
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the AssistApp desktop application on devices you own or control. You may not:
- Reverse engineer, decompile, or disassemble the Application
- Modify, adapt, or create derivative works of the Application
- Resell, redistribute, or sublicense the Application
- Remove or alter any copyright, trademark, or proprietary notices
- Use the Application for any illegal or unauthorized purpose
6. Application Permissions
The AssistApp desktop application requires certain system permissions to function:
- Microphone Access: For voice-activated help features
- Screen Recording: To provide visual guidance overlays
- Accessibility Permissions: To monitor for security threats
You can revoke these permissions at any time, but doing so may limit the functionality of the Application. All voice processing happens locally on your device and is never transmitted to our servers.
7. Caregiver Dashboard Terms
If you grant access to the Caregiver Dashboard:
- You authorize designated caregivers to view your help history and security alerts
- Caregivers may use Co-Pilot Mode to draw guidance on your screen with your permission
- You can revoke caregiver access at any time through your account settings
- Caregivers must maintain confidentiality of your information
- Caregivers may only use dashboard access to provide assistance and support
8. Acceptable Use Policy
You agree not to:
- Use the Services to violate any laws or regulations
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Upload or transmit viruses or malicious code
- Use the Services to harass, abuse, or harm others
- Impersonate another person or entity
- Collect or harvest data from our Services without permission
- Use the Services in any way that could damage our reputation
9. Scam Protection Disclaimer
While AssistApp provides real-time scam protection and security warnings, we cannot guarantee the detection of all threats. You are ultimately responsible for your online safety and security decisions. We are not liable for any losses resulting from scams, phishing attempts, or other security incidents.
10. User Data and Privacy
We collect and use your data as described in our Privacy Policy at https://assistapp.top/privacy-policy. By using our Services, you consent to our data practices. You retain ownership of your personal data and can request its export or deletion at any time.
11. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. The Services may be unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Technical issues or system failures
- Third-party service disruptions
- Events beyond our reasonable control
12. Termination
12.1 By You
You may cancel your subscription at any time through your account settings. Upon cancellation:
- You will retain access until the end of your current billing period
- No refunds will be provided for partial months (except within the 7-day refund window)
- Your data will be retained for 30 days after cancellation
12.2 By Us
We may suspend or terminate your access to the Services if:
- You violate these Terms
- Your account shows signs of fraudulent activity
- You fail to pay subscription fees
- We cease operations (we will provide 30 days notice)
13. Intellectual Property
All content, trademarks, logos, and intellectual property related to AssistApp are owned by us or our licensors. You may not use our intellectual property without explicit written permission.
14. Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided "AS IS" without warranties of any kind
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for losses resulting from unauthorized account access, unless caused by our negligence
15. Indemnification
You agree to indemnify and hold harmless AssistApp and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
16. Third-Party Services
Our Services integrate with third-party providers:
- Stripe for payment processing
- Google OAuth for authentication
- Resend for email delivery
Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service interruptions or issues.
17. Updates to the Application
We may release updates to the Application to add features, fix bugs, or improve performance. You agree to install updates when prompted to ensure optimal functionality and security.
18. Governing Law and Disputes
These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.
19. Updates to These Terms
We may update these Terms from time to time to reflect changes in our Services or legal requirements. Material changes will be communicated via:
- Email notification to your registered address
- Prominent notice on our Website
- In-app notification in the Application
Your continued use of the Services after such notification constitutes acceptance of the updated Terms.
20. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
